When Is a Landlord Liable for a Nuisance or Harm Caused by His Tenant?

Landlords typically are not responsible for their tenants' conduct. However, important exceptions exist.

Three Required Factors

  1. The nuisance must be one for which the landlord would be liable had he created it himself
  2. The owner must consent to or know about the problematic activity
  3. The owner must recognize that the activity poses a nuisance risk
